End User Licensing and Personal and Commercial Use of Graphics

What is Commercial?

Simply put, commercial means that you are making or hoping to make money. On the web, mailorder, email, whatever. You are selling or hoping to sell a product or service or promoting said product or service, in order to make a profit, either electronically on the web, through e-books, websites, and on printed advertising or printed items of any type to be resold. You own a website that sells or promotes any product or service at a fee and wish to use our artwork on your pages.  You own any type of online service with which you hope to make a profit.

Use of a graphic or my photographs (in whole or as part of another image) by a commercial business is considered "commercial use". This applies to web and approved print use, including editorial use on a newsletter, book, or informational website. Internal company use by a for-profit business would also considered commercial use.  

What is Personal Use?

Personal use is using our graphics collections for items such as the creation of your own desktop wallpaper, your personal email stationery or headers for emails, signature tags, and personal greetings that you send to your friends and family, personal printing projects, and the use of our graphics on your personal (non-commercial) website with our approval.

"Can I use graphics on this cd or from the eyecandee.com website or membership area to make greeting cards, e-book illustrations, rubber stamps, scrapbook or journal supplies or t-shirts or posters for sale?”  

The graphics may be used to create these items for your own personal use, gifts, and for crafts like journaling, decoupage, tattoos, home printing. The crafts you create from these images may be sold at fairs and any way you like. The images themselves may not be used as a basis for the creation of resale patterns (for instance, selling retail rubber stamps, stickers, printed scraps, cards and prints from these individual images directly). craft projects may be sold using the cd rom images at fairs, etc.

All others: Special custom-designed packages are created for you, containing art that may be reproduced in print format for profit, and there is a limitation to the number of printed copies and types of items covered by the licensing. A royalty fee above that number of printed copies would be required. Do not use our graphics from our collections for printing or manufacturing purpose without written permission and a specific license agreement to do so.

Licensing for commercial use of images is not licensing for use on resale products

Using an image on a commercial (non-personal) web page, electronic publication or report and using an image as the focus of a product design that will garner profits for you are completely different things. Special licensing is required for commercial print projects, but most times we do not allow use for mass-producing our artwork on any printed product where a profit would be gained by reselling images or items in quantity - without a specially created graphics collection and permission to do so. We would be glad to design your product and packaging and work with you on the royalty fee requirements for mass-producing our designs, but our image collections may not be used in that manner.  

Graphics from our vintage and digitally enhanced color collections on cd, on our website and in the member download area may not be downloaded for use on a website of any type for use as a display collection or gallery on your site, or offered as clipart or graphics for visitors to download, posted on message boards, with e-groups, or on online albums like webshots or any other album site where a visitor can copy and download the artwork. This is strictly enforced. You are requested to protect the pages our graphics are displayed on with a disabled right click feature, and you will find the code on our site.  Commercial site approved graphics may be used to create page backgrounds and sprinkled here and there around your site (limit 5 per site) as artwork where needed to explain or decorate your page and content. More than that per site would require page design services. You are required to have a credit and link visible on each page our graphics are used as long as you use them, not on a links or credit page. Original graphics, tubes, animations, may not be resold under any circumstances in their native format.

You may inquire directly by email about a commercial design or project, and we will work the specifics out with you and make suggestions if you need more information. Licensing is done on an item-by-item or per project basis, and fees are quoted accordingly. A commercial use package can be custom designed for printing commercially, using approved images, in a high resolution, that we create for you and your business or project, in a theme you specify.

Commercial or special use Licensing is permission to use certain graphics or collections of graphics,for a particular type of commercial project or designated use. You are gaining the right to use the art with permission, but it will always be copyrighted to and owned by eyecandee.com. Exclusive use licensing is available should you desire to be the sole user of the graphics commercially, aside from eyecandee.com, on your website or other designated and agreed-to project. Once again, the copyrights are retained by eyecandee.com, but the graphics will not be leased to another individual for the same type of project. Custom-designed graphics are yours to use commercially specifically as agreed, and permissions are given on a per-project basis. If used on websites, they may only be used on one website, and it is required to license separately for additional web sites.  

You are required to apply for permission for commercial use, outlining in a document how the graphic will be used, including a web address if used on a web page. If your site is in development, we do not issue permission without first reviewing your site to be sure it’s family friendly and free from links to adult or questionable websites, and original and custom graphics are not released until we have your website in our records to check back on occasionally. We do not allow use on any site that contains nudity, vulgarity or bigotry, and we do not allow any part of our graphics to be part of another image displayed on these sites.  

For those who have a custom-designed set of graphics in high resolution for approved commercial printing, you are required to place a credit for the artwork along with your copyright and list of sources on your introduction page in e-books and other printed or online publications. You are also required to send us hard copy of any material our graphics are used on prior to your publishing your projects, for our approval and review. For approved and custom design packaging, we require a hard copy/sample of your products bearing our graphics prior to manufacturing or mass-producing.    

Unauthorized commercial use of graphics will result in financial liability much greater than the original permissions and commercial licensing/custom graphics cd fee would be
